Most people going through a divorce are understandably concerned about the cost of a divorce. The average divorce may cost $15,000 to $30,000 and in excess of $50,000 if you must go to trial. Where does all that money go? Not surprisingly, the majority of it goes to the lawyers.
Honestly, the cost of divorce goes far beyond financial considerations. There is the collateral damage to you, your spouse, and your children. There is also the emotional cost experienced during the divorce process of anxiety, fear and stress.
The cost of divorce (both in dollars and emotionally) is directly related to how you choose to divorce your spouse.
Litigation is the way divorces were traditionally done. This process of divorce customarily has the highest costs, both emotionally and financially. A litigated divorce often involves adversarial tactics. These tactics tend to erode the emotional foundation of you, your spouse, your children and your family. If you would like to reduce the costs of divorce, two viable options are collaborative divorce or mediation.
The collaborative approach to divorce requires that both spouses hire an attorney. These attorneys agree to help you work out the terms of your divorce without going to court. This process helps you and your spouse reach an agreement without damaging yourself, your spouse or your children. This process is usually less expensive than litigation. However, since it normally requires the use of additional professionals such as a mental health professional and an accountant, the costs can mount. According to the study featured in the July 2005 issue of Money Magazine, the reported average costs for a collaborative law divorce was $16,000.
Another option is mediation. The mediation process allows you and your spouse to resolve your issues as quickly and privately as possible. Since the process is private, you can openly discuss the issues and explore possible resolutions without public scrutiny. This process also helps you and your spouse reach an agreement without damaging yourself, your spouse or your children. While your mediator’s hourly rates may not be cheaper than those of an attorney, the financial cost of mediation is much less than the prior alternatives because you spend far less time with the mediator. According to the study featured in the July 2005 issue of Money Magazine, the reported average divorce with mediation was $3,000 to $10,000.
